Even if a lady was an employed then her earning will be less than her husband. For a long time the courts were of the opinion that an award of spousal support should be helping people get back on their feet. Then in the 90s, the court departed from that view. Now the court sees it less as a temporary measure, but rather as something that the spouse who is not getting the advantages is entitled to, and that is the main purpose of spousal support.
A federal law, the Divorce Act, specifically sets out the factors to be considered in awarding spousal support. We see the current position of every spouse and the relationship of parties. If there are children then spouse support will be much higher. As because children are more depends on their mother.
IS spouse support affected by income tax regulations?
Generally spousal support payable on monthly basis and it is tax deductible for payer and taxable for the payee. It means the father gets to deduct payments and for mother, it will be included in her income and that is taxable.
